Are there any ways to get out of a DUI?

As someone who is facing a DUI charge, it’s a good idea to go over your rights. Your attorney likely has ideas on how to reduce or eliminate the charges against you with a strong defense, but he or she can’t help you do so until you give him or her all the information on what happened with your traffic stop.

The stop has to fit within the regulations provided to police. Did you know, for instance, that the police can’t just pull you over without a reason? You would have had to have gone through a red light, swerved or made other errors that would make the officer pull you over before he or she could do so legally.

The good news about that is if there was no cause for the traffic stop, you may be able to use that to get out of the DUI charge. Even if you can’t, that piece of evidence does help your attorney gain leverage with your case.

Another thing to keep in mind is how close your blood alcohol concentration (BAC) was to the limit and if the Breathalyzer read it correctly. If the breath test was not administered correctly or took readings that were too far apart, the prosecution may not have the things needed to press for charges against you or to win a case. This works in your favor, and it is something your attorney will look into.

With the right help, it’s possible to eliminate a DUI before it affects you. Your rights can’t be violated, but if they were, you may be able to use it to your advantage.
